OutGrownTM Privacy Policy

Your privacy is important to us. We want to make your experience on the Internet as enjoyable and rewarding as possible, and we want you to use the Internet's vast array of information, tools, and opportunities with complete confidence.

We have created this Privacy Policy to demonstrate our firm commitment to privacy and security. We request that you read this Privacy Policy carefully.

This policy explains the information practices of Slingshot Mobi, LLC (together with its successors and assigns, “OutGrownTM”, “we”, “us” or “our), defines the privacy options of each of our users (each, a “user”, “you” or “your”) and describes how your information is collected and used by us, the owner and operator of the www.OutGrown.com website (the “Site”) and the OutGrownTM mobile application (the “App”).

This policy covers the Site, the App and any of our related sites, services, tools or applications (together with the Site and the App, collectively, the “Services”).

By using or visiting the Services, whether or not you create an account with us, you agree to the collection and use of information in the manner described in this policy. OutGrownTM shall have right at any time and without prior notice, at its sole discretion, to revise this policy. Such revisions and additions shall be effective immediately upon notice, which may be given by any means, including but not limited to posting the revised policy on the Site and the App. You are responsible for reviewing the Site and the App periodically for any modification to this policy.

Personal Information We Collect and How It Is Used.
Our company collects information in different ways from Visitors and Members who access the various parts of our Services. We use this information primarily to provide a customized experience as you use our Products and Services, and generally, do not share this information with third parties. However, we may disclose personal information collected if we have received your permission beforehand or in very special circumstances, such as when we believe that such disclosure is required by law or other special cases described below.

The Services are powered by your content and listings and the things that you post, browse, buy and sell.

The Services also allow you in some situations to add your comments and opinions. This policy applies to all information collected through the Services and any information you provide to OutGrownTM, whether or not you create an account with us.

To use certain features of the Services or participate in certain activities sponsored by OutGrownTM, you will be required to create an account with us. You will provide us with personal information when using any of the Services or tools. When you use the Services without creating an account with us, we may collect information relating to your use of the Services as set forth under the heading “Usage Data” below. The personal information we collect when you create an OutGrownTM account may include: your name; your email address; your home or business zip code; and a user ID and password that you select.

You may also choose to access the Services through a third-party service such as Facebook, and we collect personal information provided through such thirdparty service in accordance with your privacy settings with such third-party service.

You may choose to provide us with your full home or business address in connection with your user account. The information you submit to OutGrownTM may include your text, photographs, video, graphics, music and any other materials you might submit as part of, or in conjunction with, your use of the Services. You may also choose to submit information about your child or children in connection with your use of the Services, including your child’s or children’s name(s), age(s), size(s), gender(s) and photos of your child or children. We may collect personal information about you that is provided by other users, such as through comments or likes of items you post. We also collect information about transactions you conduct through the Services, such as transaction dates and purchase prices.

The personal information collected from Members during the registration process is used to manage each Member's account (such as for billing purposes). This information is not shared with third parties, unless specifically stated otherwise or in special circumstances. However, in instances where our company and a partner jointly promote our Services, we may provide the partner certain personal information, such as the name, address, and username of persons who subscribed to the Services as a result of the joint promotion for the sole purpose of allowing us and the partner to assess the results of the promotion. In this instance, personal information may not be used by the partner for any other purpose. We may also generate non-identifying and aggregate profiles from personal information Members provide during registration (such as the total number, but not the names, of Members). As explained in more detail below, we may use this aggregated and non-identifying information to sell advertisements that appear on the Services.

If you order items directly from our Services we will use the personal information you provide only to process that order. We do not share this information with outside parties except to the extent necessary to complete that order.

Online Communications Through The Services.
The Services include areas that allow you to list items (and your related materials) and to share your comments, opinions, and messages to the public or privately to another OutGrownTM user. The Services may also include areas that allow you to post content relating to your children, children’s clothing, toys in general and other topics. Some information you choose to post to the Services may include personally identifiable information. We urge you to exercise caution when providing personally identifiable information. Remember that any personally identifiable information you disclose in the public areas of the Services can be viewed by other persons who access the Services. This is fully under your discretion as a user, and OutGrownTM is not held liable for any potential repercussions.

Data Usage.
In addition to the personal information you supply, we collect certain information to evaluate how you and other users use and interact with the Services. We use such data in the following ways: to improve the design of the Services, to provide personalization on Services, to evaluate the performance of our various features, activities and programs and for our internal business analysis purposes. The technologies we may use to gather this non-personal information may include analytics software, IP addresses, cookies, browser detection, device detection and weblogs.

We may use analytics software and other tools to collect data about how users use and interact with the Services. We may use this data to better understand various aspect of the Services, such as which features of the Services are most useful to users and which features may require improvements in future iterations of the Services. We may detect the type of web browser or device you are using to optimize the performance of the Services and to understand the mix of browsers and devices used by our users and visitors.

OutGrownTM may also contract with unaffiliated third parties to provide services, such as software for certain features within the Services, customer communications, analyzing and evaluating the information we collect, and other services. When we do this, we may provide your personally identifiable information to third parties only to provide those services, and they are not authorized to use your personally identifiable information for any other purpose.

Use of Information.
Our primary goal in collecting your information is to provide you with a personalized, relevant, and positive experience when using the Services. We use information provided by you to manage your account, to process transactions and to provide the features of the Services, to present and tailor content in a manner effective for you and your device, to notify you about changes to the Services or address questions you may have about the Services, and to send you messages in accordance with your marketing preferences.

Online Advertisements.
Our company may display our online advertisements. In those cases we share aggregated and non-identifying information about our Visitors and Members collected through the registration process as well as through online surveys and promotions with these advertisers. Additionally, in some instances, we use this aggregated and non-identifying information to deliver tailored advertisements or joint ventures. For instance, an advertiser or joint venture company tells us the audience they want to reach and provides us an advertisement tailored to the audience. Based upon the aggregated and non-identifying information we have collected, we may then display or send the advertisement to the intended audience. Our company does not share personal information about its Visitors or Members with these advertisers or joint venture companies.

We may contact you with promotions and updates relating to the Services, or for other activities and purposes. The contact information you submit will not be used for these purposes if you choose not unsubscribe from Services communications.

From time to time, you may be invited to participate in OutGrownTM sponsored activities or programs. OutGrownTM may request that you provide some or all of the above listed personal information to participate in those activities or programs. We use information collected from activities and programs to learn about users in order to improve our services and develop new products and services of interest to our customers.

We may from time to time select certain listings posted by users within the Services and display such listings for promotional purposes on a third-party social network or via email or blog postings. We may use information you submit to the Services as well as personal information (such as usernames) in connection with any such external sharing of select listings.

Voluntary Customer Surveys.
We may periodically conduct both business and individual customer surveys. We encourage our customers to participate in these surveys because they provide us with important information that helps us to improve the types of products and services we offer and how we provide them to you. Your personal information and responses will remain strictly confidential, even if the survey is conducted by a third party. Participation in our customer surveys is voluntary.

We may take the information we receive from individuals responding to our Customer Surveys and combine (or aggregate) it with the responses of other customers we may have, to create broader, generic responses to the survey questions (such as gender, age, residence, hobbies, education, employment, industry sector, or other demographic information). We then use the aggregated information to improve the quality of our services to you, and to develop new services and products. This aggregated, non-personally identifying information may be shared with third parties.

Data Security.
Access to your data is limited to authorized OutGrownTM staff or approved vendors. Although total security does not exist on the Internet, OutGrownTM shall make commercially reasonable efforts to safeguard the information that you submit to OutGrownTM.

The Services are not intended for use by children. OutGrownTM will not knowingly collect any personally identifiable information submitted by visitors to the Services site who are under the age of 13. If you are under the age of 13, please do not use the Services or submit any personal information through the Services. We encourage parents and legal guardians to monitor their children’s Internet and mobile device usage and to help enforce this privacy policy by instructing their children never to provide personal information through the Services. If you have reason to believe that a child under the age of 13 has provided personal information through the Services, please contact us, and we will endeavor to delete that information from Services.

As set forth above, the Services allow (but do not require) users to submit information about their children. Such information may include your child’s or children’s name(s), age(s), size(s), or gender(s) of your child or children. Submitting information about your child or children is always optional. We urge you to exercise caution when submitting information about your child. If you choose to submit your child’s name, we may use that information to customize your experience in using the Services (such as by displaying the child’s name in your private profile or in connection with search results), but we do not display or disclose your child’s name to other users or members of the public. If you choose to submit other information about your child (i.e., age, size or gender), we may display such information on your public profile (which may be accessed by other users and visitors of the Services) or otherwise use such information to facilitate your discussions and transactions with other users. You may remove any of this information from your account profile at any time.

Your Privacy Preferences.
Each time you list an item to the Services, the item listing will be visible to all OutGrownTM users as well as members of the public who visit the Services. If you no longer want OutGrownTM to display the items you have posted, you can delete such postings through the App. If you would like to delete a listing you have posted to the Services and are unable to do so using features within the App, please contact us at support@outgrown.com

OutGrownTM may provide or make available to users marketing communications such as e-mail newsletters, product and service updates and promotions. OutGrownTM users generally find this type of information useful.

Updating Your Account Information.
You can access and maintain your personally identifiable information on your profile page in the Services.

Disclosure Of Your Personally Identifiable Information.
We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order or legal process. It is also possible that OutGrownTM would sell all or substantially all of its assets and business. In any transaction of this kind, customer information, including your personally identifiable information, may be among the assets that are transferred.

It is our company's policy not to use or share the personal information about Visitors of Members in ways unrelated to the ones described above without also providing you an opportunity to opt out or otherwise prohibit such unrelated uses. However, we may disclose personal information about Visitors or Members, or information regarding your use of the Services or Web sites accessible through our Services, for any reason if, in our sole discretion, we believe that it is reasonable to do so, including: credit agencies, collection agencies, merchant database agencies, law enforcement, or to satisfy laws, such as the Electronic Communications Privacy Act, the Child Online Privacy Act, regulations, or governmental or legal requests for such information; to disclose information that is necessary to identify, contact, or bring legal action against someone who may be violating our Acceptable Use Policy or Terms Of Service, or other user policies; to operate the Services properly; or to protect our company and our Members.

The Services may contain links to other websites. OutGrownTM is not responsible for the privacy practices of these other sites. We encourage you to be aware when you leave our site, and to read the privacy statements of each web site that collects personally identifiable information. Some linked sites may be co-branded with our trademarks and those of our business partners. They may have the look and feel of www.outgrown.com, but the URL in your browser window will indicate that you are visiting a different site. This policy only applies to information collected by OutGrownTM.

For the purposes of this policy and California compliance the following definitions apply:

Depending on the visitor's activity, in our commercial Web site or online service, the following "personally identifiable information" may be collected, in addition to information set forth in other sections of this document.

The term "personally identifiable information" means individually identifiable information about an individual consumer collected online by our company from an individual and maintained by our company in an accessible form, and may include any of the following:

(1) A first and last name.
(2) A home or other physical address, including street name and name of a city or town.
(3) An e-mail address.
(4) A telephone number.
(5) A social security number.
(6) Any other identifier that permits the physical or online contacting of a specific individual.
(7) Information concerning a user that the Web site or online service collects online, from the user, and maintains in personally identifiable form, in combination with an identifier described within this privacy policy.

Under California Law SB 27, California residents have the right to receive, once a year, information about third parties with whom we have shared information about you or your family for their marketing purposes during the previous calendar year, if any, and a description of the categories of personal information shared. To make such a request, please send an email to support@outgrown.com and please include the phrase "California Privacy Request" in the subject line, the domain name of the Web site you are inquiring about, along with your name, address and email address. We will respond to you within thirty days of receiving such a request.
